ASIC rains down on influencers
ASIC released an information sheet for social media influencers who discuss financial products and offerings online. The information sheet that the ASIC provided pointed out that “it is your [the influencer’s] responsibility to ensure that any content you post complies with the law.” The sheet also added that Australian financial services (AFS) licensees should be aware of “your obligations as you may also be liable for any misconduct by the influencer.”The ASIC pointed out that if an Australian citizen provides people financial advice that is based on cryptocurrencies, they must hold an AFS license otherwise, they may be in breach of the licensing requirements under the law.
The regulatory authority also pointed out that the content created by influencers needs to be accurate and balanced. Furthermore, if the online post is misleading, the influencer might be breaking the law.
