The company have taken the swift decision to suspend all margin and leveraged products from 22:00 hours UTC today Wednesday 25th November.
This decision derives from a lack of clarity regarding the ‘actual delivery’ of digital assets offered to customers as part of a margin or leveraged trade. CFTC guidelines state that the customer has complete control over an asset once sourced through a spot, leveraged or margin trade leading the seller to relinquish control. Final CFTC guidelines updated in 2020 state that ‘the offeror, seller or affiliated entities cannot hold any interest, legal right or control over the commodity’ once ‘sold’ to the customer.
In order to continue to offer leveraged or margined products Coinbase will have to register with the CFTC as a commodities exchange.
