Japan adds further amendments to crypto trading guidelines
Japan’s Financial Services Agency (FSA) recently prepared a bill to amend two current cryptocurrency laws: the Fund Settlement Act and the Financial Instruments and Exchanges Act. The approval was announced today by the Japanese House of Representatives and the amendments will be put in motion starting April 2020. The main concern behind the amendments is investor protection. In order to ensure better investor protection, cryptocurrency laws will need to be tightened, especially derivatives trading regulations. Margin trading is also covered in the bill and will be limited from 2 to 4 times the initial deposit amount. The bill also addresses the legal denomination of cryptocurrencies, changing it from “Virtual Currencies” to “Crypto-Assets”. SBI Holdings delayed the launch of their cryptocurrency exchange, SBIVC, to also increase investor protection measures after the crypto-exchange Coincheck suffered a $530 million theft as a result of a hack and caused FSA involvement. In theory, the added scrutiny to crypto- regulations by the FSA may result in another SBIVC launch date delay. In regards to crypto-regulations, other countries’ laws might be influenced by Japan, as they have published a cryptocurrency regulations directory for G20 members. According to a statement made by the Japanese Finance Minister, Taro Aso, about the upcoming G20 Finance Ministers and Central Bank Ministers in Fukuoka, steps will be taken to “harness the potential benefits of technological innovation, such as distributed ledger technology, while mitigating its risks, including those posed by crypto-assets”.
