India introduces new Crypto Advertising Guidelines effective from April
The Advertising Stands Council of India (ASCI) has issued guidelines for commercials involving crypto or virtual digital assets, which will take effect on or after April 1. After April 15, 2022, all previous advertisements must comply with the new guidelines or be removed from the public domain.
India brings structured guidelines for crypto advertising
Amid several countries tightening their hands on crypto advertising, India's ASCI has developed new standards by undertaking extensive consultations with various stakeholders, including administration and the virtual digital asset (VDA) industry.The primary law makes it mandatory for all ads for VDA products and VDA exchanges or exchanges featuring VDAs, to include the following disclaimer:
"Crypto products and NFTs are unregulated and can be highly risky. There may be no regulatory recourse for any loss from such transactions."One guideline also instructs advertisers of VDA products or services in India not to use the words "currency," "securities," "custodian," and "depositories," as citizens generally connect these terms with regulated products. Moreover, any other asset class which is regulated may not be compared with the VDA products.
The new advertising guidelines also seek that the profitability or cost of VDA products should contain "clear, accurate, sufficient and updated information."
Increased Crypto marketing regulations
Regulators around the world find it necessary to regulate crypto marketing as Chairman of ASCI, Subhash Kamath, said, "Advertising of virtual digital assets and services needs specific guidance, considering that this is a new and as yet an emerging way of investing. Hence, there is a need to make consumers aware of the risks and ask them to proceed with caution".The news came shortly after Spain officially came into charge to control the crypto promotion in the European Union. The watchdogs in the United Kingdom have also been in the headlines for their strict decisions over crypto marketing.
However, Binance CEO Changpeng Zhao has commented in the past by saying that the crypto promotion ban would not affect the demand.
